Who Pays for Title Insurance in Florida?

The short answer

In Florida there is no law dictating who pays for title insurance. It is customary and negotiable, and it varies by county.

In most Florida counties the seller customarily pays for the owner's title policy. In a handful of counties (including Miami-Dade) the buyer customarily pays it. The purchase contract controls in every case.

What about the lender's policy?

When there is a mortgage, the buyer/borrower customarily pays for the lender's (mortgagee) policy. Issued together with the owner's policy at the same closing, the lender's policy is charged at a reduced simultaneous-issue rate.
